Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the Utah Treasure Hunts website and related online services (collectively, the “Services”) operated by Utah Treasure Hunts (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy Policy explains how we collect and use personal information and is incorporated by reference.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when registering. If you sign in with Google or another provider, you are also subject to that provider’s terms and policies for the sign-in process.
Acceptable use
You agree not to:
- Use the Services in violation of law or in a way that harms others or the Services;
- Attempt to gain unauthorized access to systems, accounts, or data, or interfere with the security or performance of the Services;
- Scrape, automate, or overload the Services without permission, except as allowed by standard search engine indexing;
- Impersonate any person or entity or misrepresent your affiliation;
- Upload or transmit malware, spam, or harmful or unlawful content.
We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Services or other users.
Treasure hunts, quests, and outdoor activities
Information on the Services about hunts, quests, trips, or locations is for general community and entertainment purposes. Outdoor activities involve inherent risks. You are solely responsible for your safety, compliance with laws and land-use rules, and obtaining any required permissions. We do not guarantee the accuracy, completeness, or availability of any hunt or clue content. Participation in any physical activity is at your own risk.
Digital quests and prizes
Digital quests, games, prizes, and promotions may have additional rules posted on the Site or at the time of participation. In case of conflict, those specific rules control for that activity. Prizes are subject to verification, eligibility, and any stated limitations.
Intellectual property
The Services, including text, graphics, logos, software, and other content, are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes in line with these Terms. You may not copy, modify, distribute, or create derivative works from our content without prior written permission, except as allowed by law.
Third-party services
The Services may link to or integrate with third-party websites or services (including authentication and payment providers). We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTAH TREASURE HUNTS AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50), IF YOU HAVE NOT PAID US ANYTHING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Indemnity
You will defend and indemnify Utah Treasure Hunts and its team against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms, to the extent permitted by law.
Changes and termination
We may modify these Terms or the Services at any time. We will post updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Services or other reasonable means. Continued use after changes constitutes acceptance. We may suspend or discontinue the Services or your access at any time.
Governing law
These Terms are governed by the laws of the State of Utah, excluding conflict-of-law rules. You agree that courts in Utah have personal jurisdiction for disputes arising from these Terms or the Services, subject to mandatory consumer protections in your jurisdiction where applicable.
